Mr. Booker (for himself and Mr. Kim) introduced the following bill; which was read twice and referred to the Committee on Homeland Security and Governmental Affairs
To require the Secretary of Homeland Security to cease all immigration detention operations at the Delaney Hall Detention Center in Newark, New Jersey, and for other purposes.
Section 1. Short title
This Act may be cited as the Delaney Hall Closure Act
.
Sec. 2. Definitions
In this Act:
(1) Department
The term Department means the Department of Homeland Security.
(2) Secretary
The term Secretary means the Secretary of Homeland Security.
Sec. 3. Closure of Delaney Hall Detention Center
(a) In general
The Secretary—
(1)
not later than 90 days after the date of the enactment of this Act, shall cease all immigration detention operations at the Delaney Hall Detention Center in Newark, New Jersey; and
(2)
shall not enter into any contract or agreement to operate the Delaney Hall Detention Center in Newark, New Jersey, as a facility to detain aliens in the custody of the Secretary.
(b) Termination for convenience
(1) In general
In the Government’s interest, the Secretary shall terminate any contract for the operation of the Delaney Hall Detention Center in Newark, New Jersey.
(2) Liability
The Department shall be liable only for payment under the payment provisions of a contract described in paragraph (1) for services rendered before the date on which the termination of such contract becomes effective.
